DOESN'T INDIANA ALREADY HAVE A RULE 6 FOR INDUSTRIAL STORMWATER DISCHARGES?
Yes, Indiana has had Rule 6 for about 10 years now. Rule 6 regulates stormwater
discharges from industrial sources with specific Standard Industrial Classification
(SIC) Codes, primarily those of manufacturing classifications.
Under Phase II, IDEM is revising major components of Rule 6. IDEM states that the revisions are necessary in order for Indiana to protect public health, existing water uses, and aquatic biota.
WHAT IS THE EFFECTIVE DATE OF INDIANA'S NEW RULE 6?
The exact effective date of this rule is not known yet. The Indiana WPCB final
adopted Rule 6 on May 8, 2003. The rule now must be reviewed by the Attorney
General and, after approval, signed by the Governor. The rule will then be
filed with the Secretary of State.
IDEM has stated that existing sources (industrial facilities that are currently operational) will be notified in writing by the IDEM Commissioner when it is time for their facility to comply with the new Rule 6. Once a facility receives the written notification, a completed Notice of Intent (NOI) to comply with this rule must be submitted to IDEM within 90 days.
WHAT ARE THE MAJOR COMPONENTS OF THE NEW RULE 6 PROGRAM?
The basic components of the new Rule 6 are similar to the existing program
requirements. However, the new Rule 6 has more extensive requirements. In
general, the following changes are included in drafts of the new rule:
- More detailed facility mapping,
- Mapping of regional topographic, receiving stream, and drinking water well
information,
- More detailed Stormwater Pollution Prevention Plans (SWP3), including certification
by a "Qualified Professional",
- Stormwater sampling at a minimum of once per year for the duration of the
operations,
- Increased reporting requirements, and
- If facilities are opting for a "No Exposure Certification", they
must submit the required forms to IDEM.
